ACTION: Notice of decision to acquire land into trust under 25 Code of Federal Regulations, Part 151.

SUMMARY: The Regional Director, Great Plain Region, Bureau of Indian Affairs, U.S. Department of the Interior, on the date below, has made a determination to acquire real property in trust for the Yankton Sioux Tribe and its members. The land referred to as Fischer Property Parcel 2, herein and is described as:

Lot Three Hundred Fifty-nine

(359), according to the survey of the Yankton Reservation, also described as Lot Three Hundred Fifty-nine

(359), Section Eighteen (18), Township Ninety-four (94) North, Range Sixty-three (63) West of the Fifth Principal Meridian; and

The Southeast Quarter of the Northwest Quarter (SE¼NW¼); and Lots Two (2), 357, and 358, all in Section Eighteen, Township Ninety-Four (94) North, Range Sixty-three

(63) West of the 5th P.M.;

all in Charles Mix County, South Dakota

Also described as:

Lots 357, 358 and 359 of the survey of the Yankton Indian Reservation; Lot 2 and SE¼NW¼ in Section 18, all in T. 94 N., R. 63 W., Fifth Principal Meridian, Charles Mix County, South Dakota, containing 199.90 acres more or less.

SUPPLEMENTARY INFORMATION: This notice is published to comply with the requirement of 25 CFR § 151.12(d)(2)(iii) that notice be given of the decision by the authorized representative of the Secretary of the Interior to acquire land in trust.

A copy of the determination is available from the office identified in the FOR FURTHER INFORMATION section of this notice.

Any party who wishes to seek judicial review of this decision must first exhaust administrative remedies. The Regional Director’s decision may be appealed to the Interior Board of Indian Appeals (IBIA) in accordance with the regulations in 43 CFR §§ 4.310-4.340. If you choose to appeal this decision, your notice of appeal to the IBIA must be signed by you, or Your notice of appeal sent to the IBIA must include a statement certifying that you have sent copies to these officials and interested parties and should identify them by names or titles and addresses.

If you file a notice of appeal, the IBIA will notify you of further procedures. If no appeal is timely filed, this decision will become final for the Department of the Interior at the expiration of the appeal period. No extension of time may be granted for filing notice of appeal.

You may include a statement of reasons with your notice of appeal, explaining why you believe the decision being appealed is in error. If you do not include your statement of reasons with your notice of appeal, you must mail or deliver it to the IBIA office within thirty (30) days after your file your notice of appeal. The statement of reasons and the envelope in which it is mailed should be clearly labeled “Statement of Reasons.” It must be accompanied by or otherwise incorporate all supporting documents. You must send copies of your statement of reasons to all interested parties.
