What you should know before buying property that hasbeenleasedtoPrevailing Wind Park LLC.

First, expect the price to behigherthanlandwithouta lease. If it is leased there is an additionalincomestreamthe size of which is determined by what if anything that is installed on the property. If there is no equipment or underground feeder cables, the payment is the base rate of five dollars per acre. The minimum base payment is five hundred dollars, so small acreages are compensated more fairly.

The lease is tied to the land and is for a period of Thirty years from the date offirstcommercialoperation (04/04/2020) There is a provision for the wind farm to extend the lease for two fiveyear periods, so it is possible for the lease to be in effect for up to Forty years.

This paragraph has been cutandpastedfromanactual lease: Purpose of Lease. The lease created by this Agreement issolelyandexclusively for wind energy purposes, and throughout the term of this Agreement, Lessee shall have the sole and exclusive rights to use the Property for wind energy purposes and to convert all of the wind resources of the Property. Lessee shall have no right to use the Property for agricultural, conservation or recreational purposes. For purposes of this Agreement, “wind energy purposes” means: wind resource evaluation; wind energy development; converting wind energy into electrical energy; collecting and transmitting the electrical energy converted from windenergy;andanyandall other activities related to the foregoing.

Two other interesting provisions are: crop damage shall be paid out at 150% of county average and that the wind farm will maintain at least a three-million-dollar liability insurance policy.

There also seems to be a misunderstanding of the $318,501,017.28mortgagethat theCanadianImperialBank has for financing the wind farm. Yes, as is normal, the wind farm property is covered by this mortgage but remember the wind farm is only leasing the land. The reality is that this is no different thanrentingyourland tosomeonetofarmandthem having a mortgage on the equipment they are using, you have no obligation.

So, if you become a lease holder;Congratulations,you now have a part in supplying the 200 Mega Watts of electricity that Basin Electric requested to supply their local REA coops. Plus, you arebringinginmanynewtax dollars to our State, County and local school systems.
