BOARD OF ADJUSTMENTS
OF THE CITY OF WAGNER,
CHARLES-MIX COUNTY,
SOUTH DAKOTA
The City Council convened at 5:30 p.m. on April 22nd, 2019 as the Board of Adjustment. Present were, Mayor Donald R. Hosek, City Administrator/Finance Officer, Rebecca Brunsing, City Attorney, Ken Cotton, and the following councilmen: Ron Cuka, Scott Honomichl, Tom F. Beeson, Brenda Jaton, Roger Schroeder and John Tyler. Absent: None.
The Pledge of Allegiance was recited.
The conflict of interest declaration was cited. The Mayor asked if there were any conflicts of interest. There were none.
Citizens present: Dale and Audrey Petrik, Allen Fuchs, Don and Carol Slaba, and Lori and Randy Beeson.
A motion was made by Beeson, second by Cuka for the approval of the agenda. All voted aye, motion carried.
The Board of Adjustments reviewed the recommendations of the Planning and Zoning Commission for the conditional use application of City of Wagner for property located at 300 NE Front Avenue, described as the south one-half of the south one-half of the northwest quarter of the southwest quarter of the southwest quarter (S ½ S ½ NW ¼ SW ¼ SW ¼ ) including Outlot SC-1; and the north one-half of the southwest quarter of the southwest quarter of the southwest quarter (N ½ SW ¼ SW ¼ SW ¼ ), all in Section thirty-four (34), Township ninety-six (96) North, Range sixty-three (63) West of the Fifth Principal Meridian, Charles Mix county, South Dakota, City of Wagner, Charles Mix County, South Dakota.
The City of Wagner is requestinga conditional use fora Disc Golf Course. The property is currently zoned agricultural. Parks are listed as a conditional use under this zoning designation. The recommendation from the Planning and Zoning Commission was to allow the disc golf course.
The Mayor opened the meeting and asked for comments from the public either in favor or opposition to the conditional use.
Mrs. Beeson asked if the council had given consideration to the letter they had written to the city council asking if the city would put up one half of the fence that borders their property. Mrs. Bee-son stated that if the city would match their privacy fence they would install it. If the city would choose chain link, city staff could install that.
The Mayor closed the public hearing.
Discussion followed. Prices of different fencing were discussed. A natural fence of larger trees was brought up. The city would like to wait once the disc golf course is installed to see if there is an issue with foot traffic across the property. A motion was made by Tyler, second by Schroeder to accept the recommendations of the Planning and Zoning Committee and allow the disc golf course as a conditional use. All voted aye, motion carried.
