PUBLIC NOTICE
ACTION: Notice of decision to acquire land into trust under 25 Code of Federal Regulations, Part 151. SUMMARY: The Superintendent, Yankton Agency, Bureau of Indian Affairs, U.S. Department of the Interior, on the date below, has made a determination to acquire real property in trust for the Yankton Sioux Tribe and its members. The land referred to as Zone 3-A Property, herein and is described as:
Parcel 1:
Lots three (3) and four (4) , Section twenty (20), Township ninety-four (94) North Range sixty-four (64) West of the Fifth Principal Meridian;
Parcel 2:
The west one-half of the northeast quarter (W½NE¼), northwest quarter of the southeast quarter (NW¼SE¼), and all that part of the northwest quarter of the northwest quarter (NW¼NW¼), northeast quarter of the northwest quarter (NE¼NW¼) and the southeast quarter of the northwest quarter (SE¼NW¼), lying north of the bluff line, Section twenty
(20), Township ninety-four (94) North, Range sixty-four (64) West of the Fifth Principal Meridian;
all in Charles Mix County, South Dakota.
Better described as:
In Section 20, T. 94 N., R. 64 W., 5th P.M., Charles Mix County, South Dakota, Government Lots 3 and 4, the W½NE¼, NW¼SE¼, those portions of the NE¼NW¼, and of the NW¼NW¼, and also of the SE¼NW¼ lying north of the Bluff Line, containing 198.0 acres more or less.

SUPPLEMENTARY INFORMATION: This notice is published to comply with the requirement of 25 CFR § 151.12(d)(2)(iii) that notice be given of the decision by the authorized representative of the Secretary of the Interior to acquire land in trust.
A copy of the determination is available from the office identified in the FOR FURTHER INFORMATION section of this notice. Any party who wishes to seek judicial review of this decision must first exhaust administrative remedies under 25 CFR Part 2. This decision may be appealed to the Great Plains Regional Director in accordance with the regulations in 25 CFR Part
2. Your notice of appeal must be filed in the Superintendent’s office at the address listed in the FOR FURTHER INFORMATION CONTACT section above within thirty
(30) days of the date of publication of this notice. The date of filing your notice of appeal is the date it is postmarked or the date it is personally delivered to the Superintendent’s office. Your notice of appeal must include your name, address, and telephone number and it should clearly identify the decision being appealed. If possible, attach a copy of the decision. The notice and the envelope in which it is mailed should be clearly labeled “Notice of Appeal.” Your notice of appeal must list the names and addresses of the interested parties known to you and certify that you have sent them copies of this notice. You must also send a copy of your notice of appeal to the Regional Director at: Great Plains Regional Office, Bureau of Indian Affairs, 115 4th Avenue S.E., Suite 400, Mail Code 100, Aberdeen, South Dakota 57401. If you are an Indian or Indian Tribe and are not represented by an attorney, you may request assistance from this office in the preparation of your appeal.
You may include a statement of reasons with your notice of appeal, explaining why you believe the decision being appealed is in error. If you do not include your statement of reasons with your notice of appeal, you must mail or deliver it to the Superintendent’s office within thirty (30) days after your file your notice of appeal. The statement of reasons and the envelope in which it is mailed should be clearly labeled “Statement of Reasons.” It must be accompanied by or otherwise incorporate all supporting documents. You must send copies of your statement of reasons to all interested parties and the Regional Director.
If no appeal is timely filed, this decision will become final for the Department of Interior at the expiration of the appeal period. No extension of time may be granted for filing a notice of appeal.
