CITY TO HOLD PUBLIC MEETING TO DISCUSS FIREWORKS ORDINANCE

The City of Lake Andes will hold a public meeting on January 25, 2021 at 7:00 pm at the Lake Andes Community Building to discuss the Fireworks Ordinance. The purpose of the meeting is to discuss potential changes to the Ordinance. Please plan to attend and offer input regarding the proposed changes to the City Ordinance. The city council has considered the discussions that took place at the Public Meeting in September 2020 and the following ordinance proposal has been prepared for the public to review:

Sec. 2. Unlawful discharge of fireworks.

It shall be unlawful for any person to shoot, discharge, explode, or cause to be shot, discharged or exploded, any fireworks within the City of Lake Andes except during the following time periods:

June 27th thru July 2nd - 6:00 o'clock p.m. to 10:00 o'clock p.m.

July 3rd and 4th –2 o’clock p.m. to 12:00 o'clock a.m. (midnight)

July 5th - 6:00 o'clock p.m. to 10:00 o’clock p.m.

December 31 – 8:00 o’clock p.m.-January 1-1:00 o’clock a.m.

It shall be unlawful for anyone under the age of 18 years of age to shoot, discharge, or explode fireworks or cause fireworks to be shot, discharged, or exploded within the municipal boundaries of the City of Lake Andes without the supervision of a person over 18 years of age.

Sec 3. Discharge of Fireworks on Public Property

It shall be unlawful for any person to shoot, discharge, explode or cause to be shot discharged or exploded any fireworks on any public property within the municipal boundaries of the City of Lake Andes. City public property shall include, but not be limited to, streets, alleyways, swimming pool, public library, and parks. It shall be a violation of this provision if the offender shoots discharges or explodes fireworks from a vehicle located on city public property.

Sec.4. Violation of Article VI of Chapter 12.

Any violation of the provisions of Chapter 12 Article VI shall be punishable by a fine not to exceed five hundred dollars ($500.00) for each separate offense. In addition, as part of the enforcement procedures for this ordinance, all fireworks of any nature or sort possessed by a person who violates this ordinance shall be confiscated from said person at the time of their arrest and destroyed. Further, said confiscation shall be in addition to and not in lieu of any other, further, additional, or different remedies available to the City pursuant to these ordinances.
